Artist Contract

For artists participating in Healing Art Curator exhibits: read this agreement and then fill in your name, check the box and click the Submit button at the bottom of this page.

All work must be original, finished with appropriate hardware, ready to hang and identified on the back with clearly printed: Artist, Title, Media, Dimensions and Price.

Artist is responsible for any and all packing, shipping, insurance, delivery and pick-up of artworks.

Photography, filming, and videography of the Exhibition, including television coverage, may be permitted for documentary, educational, or publicity purposes and used in perpetuity with no further consent needed.

Artist receives 50% of total retail price for each artwork sold. Curator handles all sales proceeds, processes and equipment. Commissions will be paid within thirty days of takedown of the exhibition. In addition to agreed retail price, applicable sale taxes will be added to the bill of sale.

Artist retains copyright and full ownership of the artworks. In the event of the purchase of artwork, the title shall pass directly from Artist to the purchaser.

Return policy for all artwork is a 100% satisfaction guarantee. Buyers have 10 days from receipt of work to return it for a full refund of the purchase price. Shipping fees are over and above purchase price and are therefore non-refundable. Buyer is responsible for cost of return shipment of artwork.

Artwork is handled with care and with reasonable safety measures, thus, Curator and Host are not held liable for damages, theft or acts of God. Artist agrees to indemnify and hold Host and Curator harmless from any personal injury or property damage claim that may occur as a result of the exhibition. Except with respect to claims arising from a Party’s separate negligence or willful acts, which shall remain that Party’s personal obligation, each Party agrees to defend, indemnify and hold harmless the other Party with respect to a claim arising from the Party’s actual or alleged act, failure to act, error, or omission in the performance of their obligations under this Agreement or any governing law or regulation.

This Agreement may be terminated at any time by Curator, Host or Artist, by means of written or confirmed digital notification of termination. Upon notification of termination, all accounts shall be settled and all unsold artworks shall be returned within ten business days. Artists will have a period of no longer than ten business days to remove any and all property from the exhibition space if Host or Curator terminates their exhibition before the specified exhibit end date. Property left behind after this period will be considered abandoned and may be destroyed or disposed of. In the event of Artist’s death, the estate of the Artist shall have the right to terminate the Agreement.

This Agreement shall be governed by the laws of the State of Arizona. All disputes arising under this Agreement shall be submitted accordingly, and the arbitration award may be entered for judgment in any court having jurisdiction thereof.
